 Photo Contest -- Rules and Regulations

General

These Rules and Regulations are final on all matters relating to Cliffcrest Scarborough Village SW Residents Association’s (the “Association”) Photo Contest (the “Contest”). By entering, all entrants agree to be bound by these Rules and Regulations.

Eligibility

To be eligible to enter the Contest or win a prize, you must be of the age of majority in, and a esident of, Ontario, and photos must be from Cliffcrest Scarborough Village SW region (south of Eglinton Ave to Lake Ontario, and between Markham Rd and Brimley Rd). Participation in the Contest constitutes Entrants’ full and unconditional agreement to abide by these Contest Rules and Regulations and the Association’s decisions, which are final and binding in all matters related to the Contest.

Personal Information

Personal Information collected from Entrants by the Association will be used by the Association to administer the Contest and in connection with the publication of winning photographs. The Association will not share personal information relating to Entrants with any third parties, except as necessary for the administration of the Contest or as may be required by law. The Association will not attempt to contact the Entrant for any other purpose than to administer the Contest or as may be required by law unless they have opted-in to receive relevant communications from the Association. The Association respects the privacy of everyone who enters the contest.

Submission of Photographs

Entries must be submitted by email to events@csvsw.ca in JPEG format. Submissions must include “Photo Contest” in the Subject line of the e-mail, your name, address, title and brief description of your photo (including where it was taken and a short message about why you enjoy visiting this neighbourhood) to be eligible.  Photos must not include images of identifiable individuals – any such photo(s) will not be considered. Contestants must have taken the photo and be the sole owner of all rights of the photo(s) that they submit.

Content alteration of digital files is not acceptable; cropping of photos is permitted, tonal or colour corrections are acceptable, including black and white conversion. For photographs that are selected as winning entries, the high-resolution version of the photograph will be required for reproduction. Entrants who fail to provide a high-resolution version within the time period set by the Association (not to exceed one week following prize notification) will forfeit the prize and an alternate winner will be selected by the judging panel. In such a case, no substitute prizes will be awarded.

Usage of Entered Materials

Subject to the following terms, copyright in all photographs submitted for this Contest remains with the respective entrants. However, by entering the Contest each entrant expressly grants the Association a non-exclusive, worldwide, irrevocable, perpetual license to use, reproduce, publish and/or display any or all of the submitted photographs in digital or print format, including on its website and social media platforms, and/or in material connected to this Contest or other future uses as the Association determines, and you waive all claims of moral rights in connection with the foregoing. You represent and warrant that you have the right to grant the licence set out above and agree to hold the Association harmless from any losses it may suffer or become liable for as a result such representation and warranty being untrue in any manner.  Each entrant also permits the Association to use his or her name in connection with his or her photograph.

Deadlines

Contest opens October 3, 2020 and closes at midnight ET on January 3, 2021. All photographic entries must be submitted by 11:59 p.m. ET on January 3, 2021.  Contest winners will be notified, and their photos posted to our website (with the winner’s name), on or about January 31, 2021.

All paper entries become the property of the Association and will not be returned. The Association is not responsible for entries lost, late, misdirected, illegible or delayed for any reason.

Judging

The winners will be selected by a panel of one or more judges selected by the Association using the following criteria: (i) creativity; (ii) uniqueness; (iii) adherence to theme; (iv) composition; and (v) colour, lighting, exposure and focus.

All photographs submitted to the Contest will be reviewed by the Association and the Contest winners will be selected by the Association’s representatives. All decisions of the judging panel are final.

Chances of Winning

The chances of winning a prize will depend on the number of eligible photographs received and the evaluation of the photographs by the judging panel.

Prizes

Winners will receive no compensation, credit or prizing other than as disclosed in these Rules and Regulations or otherwise provided at the sole discretion of the Association. Prizes are not transferable; no prize substitutions or equivalents are permitted, except by the Association at its sole discretion. In all cases, the Association reserves the right to substitute a prize of equal or greater value for any of the Contest prizes.

All prizes must be accepted as awarded.  Available prizes are described at www.cliffcrestscarboroughvillagesw.ca/current-events-projects/ Winners will be notified using the e-mail address associated with their entry. Winning photographs and entrants’ names will also be posted to the Association’s website and social media platforms. 

By accepting a prize, the prize winner agrees to hold the Association and anyone else involved in the development, production or handling of the Contest and their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of acceptance or use of a prize.

Disputes

By participating in the Contest, each Entrant agrees to be bound by these Contest Rules and Regulations. In the event of any disagreement as to whether a person is an Entrant, a potential winner or a winner, or as to the qualification of any Entrant, potential winner or winner to, or the adequacy of any prize or any substitute prize, the decision of the Association will be final.
